New York City (Local Law 144): Requires employers using automated employment decision tool (AEDT) tools for hiring or promotion to conduct independent, annual bias audits and publish a summary of results.
Maryland (HB 1202): prohibits employers from using facial recognition services during an applicant’s pre-employment interview without consent.
California (CCRC & CCPA): Introduced a four-year record retention requirement for AI workplace data and, by 2027, will grant employees a “Right to Opt-Out” of automated decision making.
While the laws above only apply to their specific jurisdictions, it may be a good idea to reference these as best practices to support transparency and ethical use of AI and to reduce legal risks in the future.
Courtroom Precedents: Who is Liable?
Speaking of legal risk, below is a list of key court cases with lasting implications on AI use in the workplace.
Mobley v. Workday: A landmark case establishing that AI vendors can be considered “agents” of the employer. This means if the software violates Title VII or other federal civil-rights laws, the AI company is just as liable as if a human recruiter made the same biased choice.
EEOC v. iTutorGroup: Resulted in a $365,000 settlement after their AI software was caught auto-rejecting candidates based on age (women over 55, men over 60), violating the Age Discrimination in Employment Act (ADEA).
Eightfold Class Action: Shifts the AI legal landscape to data privacy through the Fair Credit Reporting Act (FCRA). The suit alleges the creation of “hidden credit reports” on job seekers, signaling that how you use data is now as legally sensitive as the outcome of the decision.
Emerging Risk Areas
Beyond recruitment and hiring decisions, AI use may elicit other risks. Human Capital professionals should watch out for these additional risks when considering additional ways to implement AI:
AI-Driven Compensation: Using AI to set wages, particularly based on employee location, can lead to “digital redlining” if the algorithm uses location-based data as a proxy for protected classes.
AI-Driven Discipline & Punishment: Considering the biases involved in the AI selection process, utilizing AI in discipline and punishment decisions is inadvisable. While allowing AI to make those decisions is inadvisable, utilizing AI to understand relevant case law, understand different perspectives, or how to communicate discipline and punishment can potentially prove beneficial, though it is important to validate it’s findings.
The Privacy Gap: AI productivity monitoring (or “Bossware”) is increasingly linked to lower employee engagement and heightened legal scrutiny regarding the right to privacy.
Due Process: If an AI scores an employee’s performance low, that employee has a right to know why. Without a clear grievance policy and “Explainable AI” (XAI) tools, organizations are defenseless in court.
Best Practices for the Ethical Employer
Audit your vendors: Don’t take a salesperson’s word for it. Demand technical reports on predictive validity and conduct your own independent audits.
Prioritize Advanced AI Technology: Use Explainable AI processes (XAI, not to be confused with Elon Musk’s xAI) to ensure every automated decision has a traceable, human-readable “paper trail”
Maintain a Human-in-the-Loop: AI should assist, not decide. Ensure final “high-risk” decisions (firing, pay cuts, hiring) are authorized by a human.
